Dear friends,

I am proud and pleased to tell you that last Thursday, after two and a half years in detention, Ma’an Abu Hafez finally returned home and was reunited with his family.

You may remember Ma’an’s story: he was born in Brazil and came with his parents to the West Bank at the age of three. Although Ma’an has lived in the Jenin refugee camp ever since, he never received any legal status there, due to Israel’s freeze policy on family unification in the Occupied Territories. In February 2017, Ma’an was arrested by the military inside the West Bank and immediately handed over to the Ministry of Interior, which detained him as an “illegal alien”, while pursuing his deportation to Brazil.

HaMoked repeatedly challenged Ma’an’s detention, but the Tribunal for Review of Custody of Illegal Aliens remained unyielding. We also filed a petition to the High Court of Justice (HCJ) against the denial of Ma’an’s family unification application. During the HCJ hearing two weeks ago, thanks to pressure from the justices, the state relented, making it possible for us to negotiate  Ma’an’s release.

Three cheers go to HaMoked’s attorney Nadia Daqqa, who refused to give up and left no stone unturned in her efforts to return Ma’an to his family.

חברות וחברים יקרים,

אני גאה ושמחה לבשר לכם שביום חמישי האחרון, לאחר שהוחזק בכלא במשך יותר משנתיים וחצי, מען אבו חאפז שוחרר לביתו והתאחד עם משפחתו.

כזכור, מען נולד בברזיל והגיע עם הוריו לגדה המערבית כשהיה בן שלוש, ומאז הוא מתגורר במחנה הפליטים ג'נין. למרות זאת, מען מעולם לא קיבל כל מעמד חוקי בגדה, בגלל מדיניותה של ישראל, שמונעת זה שנים איחוד משפחות בשטחים הכבושים.

בפברואר 2017, מען נעצר על ידי הצבא בתוך הגדה המערבית ומיד הועבר לידי משרד הפנים, שכלא אותו כ"שוהה בלתי חוקי", בניסיון להביא לגירושו לברזיל.

פעם אחר פעם, בית הדין לביקורת משמורת של שוהים שלא כדין דחה את בקשות המוקד לשחרר את מען. במקביל, המוקד עתר לבג"ץ נגד הסירוב לאשר את בקשתו של מען למעמד מתוקף הליך לאיחוד משפחות. במהלך הדיון בבג"ץ שהתקיים לפני כשבועיים, בעקבות לחצם של השופטים, המדינה נסוגה מעמדתה, וניתן היה להגיע להסכמה על אופן שחרורו של מען. 

קריאות הידד מגיעות לעורכת הדין של המוקד, נדיה דקה, שסירבה להרים ידיים ופעלה ללא לאות כדי שמען יוכל לשוב למשפחתו.
